Caregiver / Service Provider Terms

These Caregiver / Service Provider Terms (“Caregiver Terms”) govern the participation of caregivers, service providers, contractors, and similar individuals (collectively, “Providers”) who use the HUB Healthcare platform (the “Platform”).

These Terms supplement the HUB Platform Terms of Service. By registering as a caregiver or service provider on the Platform, you agree to comply with these Caregiver Terms as well as the Platform Terms of Service.

1. Independent Contractor Status

Providers using the Platform are independent service providers.

You acknowledge and agree that:

you are not an employee of HUB Healthcare, LLC;

HUB is not a staffing agency, home care agency, or nurse registry;

HUB does not control how you perform services;

HUB does not supervise, train, or manage Providers;

you are responsible for how services are performed.

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and HUB.

2. Provider Responsibilities

As a Provider using the Platform, you are responsible for:

determining whether you are qualified to perform any service offered;

complying with all applicable laws and regulations;

obtaining any licenses, certifications, or permits required for services you perform;

maintaining any required insurance;

accurately representing your qualifications and experience;

providing services safely and professionally.

You are solely responsible for evaluating each request and determining whether you are able to perform the requested service.

3. Prohibited Medical or Clinical Services

Unless specifically permitted under applicable law and properly licensed, Providers may not use the Platform to offer or perform medical, clinical, or regulated healthcare services.

Providers should not:

diagnose or treat medical conditions;

administer medications;

provide clinical procedures;

represent themselves as medical professionals unless properly licensed.

The Platform is intended primarily for non-clinical support services unless otherwise approved.

4. Accuracy of Profiles and Representations

Providers must maintain accurate and truthful information in their profiles.

You may not:

misrepresent your identity;

misrepresent qualifications or experience;

claim licenses or certifications you do not possess;

falsify credentials or background information.

Providing false information may result in removal from the Platform.

5. Background Checks and Verification

HUB may offer or require background checks or identity verification through third-party providers.

Providers acknowledge that:

checks may be limited in scope;

checks may not capture all criminal history;

checks may be periodic rather than continuous.

Providers remain responsible for their conduct and compliance with the law.

6. Safety Expectations

Providers must follow reasonable safety practices when interacting with clients or entering homes or facilities.

Providers should:

assess environments for safety risks;

decline unsafe requests;

report unsafe conditions where appropriate.

HUB is not responsible for conditions in client homes or locations where services occur.

7. Scheduling and Availability

Providers control their own schedules.

You may choose whether to:

accept or decline service requests;

set availability;

determine the services you are willing to provide.

Repeated cancellations or missed appointments may lead to restrictions on Platform access.

8. Compensation and Payments

Providers are responsible for understanding compensation terms before accepting a request.

Payments may be processed through third-party payment processors.

Providers are responsible for:

accurate payout information;

tax reporting;

complying with all applicable financial obligations.

9. Taxes

Providers are responsible for all tax obligations arising from income earned through the Platform.

HUB does not withhold taxes unless required by law.

Providers should consult tax professionals regarding their obligations.

10. Conduct Standards

Providers must treat clients respectfully and professionally.

Providers may not:

harass or discriminate against clients;

engage in abusive or unsafe conduct;

request inappropriate personal information;

misuse the Platform.

Violations may result in account suspension or removal.

11. Insurance

Providers are responsible for maintaining any insurance required for services they provide.

HUB does not provide liability, professional, workers compensation, or health insurance coverage for Providers.

12. Reporting Concerns

Providers should report safety concerns, misconduct, or illegal activity encountered through the Platform.

HUB may review reports and take action where appropriate.

13. Suspension or Removal

HUB may suspend or remove Providers from the Platform if:

these Terms are violated;

unsafe conduct is reported;

false information is discovered;

fraud or illegal activity is suspected.

HUB is not obligated to continue allowing access to the Platform.

14. Limitation of HUB Responsibility

HUB is a technology platform only.

HUB is not responsible for:

service outcomes;

provider conduct;

client conduct;

disputes between users.

15. Changes to These Terms

HUB may modify these Caregiver Terms at any time.

Updated versions will be posted on the Platform with a revised effective date.

Continued use of the Platform constitutes acceptance of revised Terms.
